These are the terms and conditions for individuals attending events run by MacKay Hannah Ltd, whether online or face to face.

1. General

1.1 When submitting a booking via web, email or phone, delegates (or those acting on their behalf) enter into a legally binding agreement with MacKay Hannah Ltd to attend an event run and managed by MacKay Hannah Ltd based on these terms and conditions.

1.2 MacKay Hannah cannot be held responsible for any individual failing to get appropriate authorisation prior to booking and any individual making a booking will be held personally responsible for payment should their organisation fail to pay for this reason. 

1.3 MacKay Hannah Ltd reserves the right to refuse any booking.

2. Confirmation

2.1 All bookings will be confirmed by email.

3. Booking fee

3.1 All fees for attending events or ordering video recordings are clearly shown on the individual event web pages.

3.2 Video recordings – the option of ordering the video recording only is intended for any individual who would normally have attended the event but – for whatever reason – is unable to do so on the day.  It provides that individual with a full recording of the event, allowing them to view it at a later date.  It is not permissible to share that video recording with groups of individuals, eg collectively as a staff team or by sharing with team members individually.  If that is your intention, you should contact us to discuss a group rate for such viewings.  Please note that any individual logging on to view the recording will be required to register their details at the point of doing so.    

3.3 VAT will be added to all fees at the current rate.

4. Offers and discounts

4.1 From time to time, offers or discounts run simultaneously. Please note that only one offer or discount can be applied to any single booking. 

4.2 From time to time, special offers may be applied to individual conference rates for a limited period only.  Again, only one discount can be applied to any single booking.  Such discounts are not applicable to any bookings already made, ie you cannot cancel an existing booking and then re-book in order to qualify for the discounted rate. 

5. Payment

5.1 We do not currently accept payments online and will send you an invoice.

5.2 Payment is due within 10 days of the date shown on the invoice.

5.3 You have the option of paying by bank transfer or card. 

5.4 Band details will be included on the invoice.  

5.5 If you wish to pay by card, please tick the appropriate box on the booking form and MacKay Hannah Ltd will contact you by telephone to take the payment. 

5.5 Alternatively you may call 0131 556 1500.    

6. Variations, programme and speakers

6.1 The views expressed by speakers are representative of their own opinions and cannot in any way be attributed to MacKay Hannah Ltd.  MacKay Hannah Ltd takes no responsibility for the actions of delegates which are based on such views and opinions.

6.2 In the event of speakers being unable to attend, or any other circumstances beyond MacKay Hannah Ltd’s control which necessitate change, MacKay Hannah Ltd reserves the right to alter or amend the event as advertised including the programme, speakers, timing, location or any other particulars as appropriate.

6.2 Any refunds arising from such variations will be at the sole discretion of MacKay Hannah Ltd.

7. Cancellation, postponement and substitutions

7.1 Cancellations must be submitted in writing by post to 84 Liberton Brae, Edinburgh EH16 6LB or by email to ghannah@mackayhannah.com.

7.2 Any delegate place cancelled will be entitled to a refund of 50% of the fee provided notification of the cancellation is received in writing at least 30 days before the event.

7.3 No refunds will be given for any delegate cancellations made less than 30 days before the event, whatever the reason, but substitute delegates are welcome and details should be provided to MacKay Hannah Ltd in advance of the event. 

7.4 If a delegate fails to attend, without advising MacKay Hannah Ltd in writing in advance, the full fee will remain payable to MacKay Hannah Ltd.

7.5 In the event that MacKay Hannah Ltd postpones an event, MacKay Hannah Ltd reserves the right to retain the fee paid until advised by the delegate that they wish to either cancel their place or attend on the rescheduled date.  If the delegate is unable to attend on the rescheduled date (or to offer a substitute delegate) a full refund will be made to the delegate/organisation within 28 working days.

7.6 In the event that MacKay Hannah Ltd cancels an event, delegates shall be entitled to a refund of their fee less any costs reasonably incurred by MacKay Hannah Ltd.

8. Filming and photography

8.1 MacKay Hannah Ltd will record online events and may record, film or take photographs (including flash photography) at face to face events.  Such media may be used in publicity and marketing materials, including on MacKay Hannah Ltd’s website.  Your attendance at an event may mean you are featured in such media and, unless you notify us of your objection to this, your consent will be implied. 

8.2 If you do not wish to be included in any media, please notify us prior to the event.

9. Liability

9.1 Nothing in these Terms and Conditions excludes or limits the liability of either party for death or personal injury caused by negligence or any other liability which cannot lawfully be excluded or limited.

9.2 MacKay Hannah Ltd will take all reasonable steps to ensure the safety of all those attending its events but will not be liable for any indirect or consequential losses by those individuals taking part in events.

10. Indemnity

10.1 Delegates shall indemnify MacKay Hannah Ltd in full for any direct or indirect loss or damage MacKay Hannah Ltd incurs as a result of the delegate’s acts or omissions, including any losses arising from damage to the venue, MacKay Hannah Ltd or third party property or failure to comply with any requirements specified by MacKay Hannah Ltd.

11. Delegate obligations

11.1 Delegates agree to comply with any requirements communicated by MacKay Hannah Ltd, the venue, contractors or agents, including instructions relating to health and safety, fire safety or consumption of food and drinks.

11.2 Delegates must inform MacKay Hannah Ltd of any specific requirements such as dietary or accessibility requirements or any other matter pertinent to their attendance at the event as soon as practicable after placing their booking.

11.3 Delegates agree to conduct themselves reasonably at the event and MacKay Hannah Ltd reserves the right to exclude or remove anyone not behaving appropriately.

12. Force majeure

12.1 MacKay Hannah Ltd shall not be liable for any failure or delay in the event for circumstances beyond its control which could not reasonably have been foreseen or provided against.

13. Data protection

13.1 Delegate’s personal information will be held by MacKay Hannah Ltd in accordance with MacKay Hannah Ltd’s Privacy Policy and any privacy notices included on the event booking form or website or provided to delegates from time to time.

MacKay Hannah is committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, it has put in place suitable physical, electronic and managerial procedures to safeguard and secure the information collected.
